Five-Year Old Boy Awarded $35 Million Settlement

In 2004 Andrew Arkebauer, a five-year old boy, was awarded a record $35 million settlement due to a brain injury case against an anesthesiologist at Northwestern Memorial Hospital. This was the most money awarded in a birth brain injury lawsuit in the state of Illinois at the time.

Andrew Arkebauer was delivered by a Caesarean section delivery back on October 4, 1998 with several birthing complications. His mother, Evelyn Arkebauer began labor at Northwestern Memorial Hospital when her obstetrician doctor ordered a Caesarean for her, after she was not giving birth. Anthesiologist Dr. Edwin Lojeski was present in the hospital but did not answer any of the three pages sent to him. He was reported by a nurse in the hospital to be in a private call room with the nurse, one room below Evelyn Arkebauer’s delivery room. After he reported 45 minutes later to proceed with the Cesarean, Eveyln Arkebauer was already experiencing fetal distress. Andrew Arkebauer was born with brain damage. He cannot walk, feed himself, and will need care for the rest of his life. His parents were pleased with the settlement. The Arkebauer’s now feel confident that he will be provided for the rest of his life, even after they pass.



$6.5 Million Awarded to Brain Injury Malpractice Case

A Chicago family was awarded a $6.5 million settlement in January 2009. The family filed a lawsuit against Provena Mercy Medical Center due to the negligence of the medical team when delivering their baby in 2001, causing the baby brain damage. The mother was given the common drug Pitocin to excel labor. However, the side effects of the pill caused distress to the unborn baby. The doctors and nurses failed to assist the baby in distress, resulting in brain damage. It was found in court that Provena Hospital was not prepared to handle such situations, which resulted in the $6.5 million settlement.
