New Jersey Car Accident Laws Important Info for Drivers

New Jersey has a Fault under a Standard Policy which means Proportional Comparative Fault of 51% in a car accident with a no fault policy. With a standard policy you may decide to give up your right to sue for specific non-debilitating injuries.

In New Jersey your car insurance requirement is to have a Basic Policy in case of a car accident. This policy is mainly made up for young drivers who have very few assets to lose. The policy will pay $15,000 for each person in the accident and $5,000 of property damage liability.

If you injure a person or persons in the other vehicle, your Basic Policy will not automatically cover their injury costs. You may add $10,000 coverage for every person involved in the car accident for an extra fee. You may also add $250,000 injury protection to your policy as well. You can also add collision/comprehensive insurance that will cover your car or vehicle.


You are offered a Standard Policy as well. This policy will protect your assets. Each person in the accident that is covered under your policy is protected with $250,000 for personal injury. You will get $5,000 in property damage, $15,000 bodily injury liability for each person and $30,000 (less or more) for each accident to cover other people involved in the accident if you were the cause of the accident. You can also add collision/comprehensive to your vehicle coverage. You may also choose to add uninsured motorist coverage to your Standard Policy.

In New Jersey the small claims limit is $3,000.

If you are in a car accident you have two years from the date you were injured to file a claim.

If you were in a car accident with an employee of the government driving a government vehicle, you may file a lawsuit with the government agency. The government agencies are the county, state, city or town, a public agency or a school.

Before you file a lawsuit against the government agency, you must file a Notice of Claim within 90 days of the car accident. The Notice of Claim should state the date of the car accident, the cost of the damage, etc. You may want to contact a lawyer or speak to someone who can help you to make sure you get all of the correct information.
