An injury lawyer has spoken out about professional negligence within the swimming pool industry and the products it provides.

The lawyer has warned homeowners with swimming pools, that their filters could be faulty and that they could be swimming by a ticking bomb.

Kevin Lancaster stated that he has had several complaints from families over such a product, after they received personal injuries: "I've had four calls this morning about four different pool filter explosions," he said.

However, these calls no longer surprise Lancaster, as he has been fighting on behalf of people injured or killed by exploding pool filters, for nearly 20 years.

The average call consists of how a man is now in the emergency ward from the faulty product, or a female who has several bruises and loose teeth after a filter blew up and threw her against the garden wall. One man received a four inch gash in his head after the product exploded.

Lancaster commented on one shocking case: "I represented a man a few years ago who owned his own fibre optics company. The pool filter exploded, he was thrown backwards on to the pool deck and suffered a brain injury and had to quit working. I also did a wrongful death case for the family of a man who was killed. He was leaning over the pool filter to check the pressure gauge and he was killed when it blew up."

Professional negligence is easy swim

The injury lawyer is warning consumers about the everyday garden variety cartridge pool filter system or two part ‘clam shell,' which he says are the most "dangerous types."

As pool owners know, the filter system has to be cleaned about twice a month. The cardboard filters have to be removed, hosed downed and put back in and then the tank has to be pressurised again. This is where things get tricky.

However, Lancaster said that the companies providing these filters are performing professional negligence, as they know the products they are selling are dangerous.

Although cleaning the filter requires little knowledge and few tools, it is very easy to get it wrong. Leaving too much air in the tank can cause a disaster.

"Manufacturers want consumers to think the filter is easy and safe to use. If you look at any ad for a swimming pool filter it has some babe in a two-piece swimsuit and she is all wet and she is smiling and she is having the time of her life but it is really a bomb," he stated.

He said that manufacturers have made a few slight changes to the item, but knew that if they made too many changes, it would be more time consuming for the customer, so they limited the safety standards.

"We litigate these things and they keep getting settled with confidentiality agreements," says Lancaster. "I think it is more profitable to hurt people than it is to fix these things."

Lancaster commented that he would be very happy if he never had another phone call about someone tragically injured in their own garden because of a cartridge pool filter system accident.

However, he acknowledged that seems unlikely. A redesign might mean it would take longer to clean the filters, or require special tools or even special knowledge to clean the pool for the weekend.

"I would be very happy if I never had another case like these," he ended.
