Bankruptcy attorney Benjamin Ginter runs the Law Offices of Benjamin J. Ginter in Cranford, New Jersey. Here, he says that bankruptcy attorneys are the key to filing a successful bankruptcy. They counsel you every step of the way, make sure you file the right chapter, and explain how you can expect to rebuild your life afterwards.

What a bankruptcy lawyer helps
Some people do have a simple case that they could possibly do on their own. But it’s a good idea to have an attorney guide you through the process and make sure you do things correctly.

Bankruptcy lawyers work with clients who are having financial difficulty and are looking to have their debt wiped out in bankruptcy. They help their clients get a fresh start, and make them feel that they can live a productive life without the worry of being sued. Most importantly, attornerys protect their clients.

A debtor must attend the creditors’ meeting scheduled for his bankruptcy petition, which is conducted by the trustee. Creditors have been notified that they may question the debtor about his assets or any other matter relevant to the bankruptcy. The debtor must answer questions concerning:

• How the situation evolved
• Any actions taken with the property
• Debts listed in the petition or any other financial information requested by the trustee

Failure to respond or not respond truthfully can result in the petition being dismissed or, in extreme cases, a charge of perjury. Most clients come in ashamed of what they are going to do, and they feel like they have failed.

But a good bankruptcy attorney will be there to educate the client, to answer the client’s questions, and to treat him with respect and dignity. The attornery will also counsel the client to assure him that he is not doing anything illegal or wrong, and to help him get back on his feet.

Filing bankruptcy is not immoral
The bankruptcy law is in place because the system of law recognizes that your life and future should not be ruined because of some financial mistakes you've made or events that might have happened out of your control. You should never feel ashamed or like a failure if you decide to file for bankruptcy. The truth is, millions of people have filed, especially during this weak economic period. Even major billion dollar corporations file for bankruptcy. Hold your head up high and remember that bankruptcy can give you a fresh start.
