How to legally resolve child custody issues

Custody battles can quickly get out of hand when parents don't follow the law. Parents will battle each other tooth and nail over the children. Children have the right to a normal and settled life. Parents should never drag their children through a bitter custody battle. It isn't good for the well-being of the children.


Here is how to legally resolve custody issues:


Do Not Contact the Other Parent

Whatever the issues are concerning child custody, parents should never contact each other during the custody battle. Hire a lawyer who specializes in child custody cases. Let the lawyers relay messages. If you allow the lawyers to handle the issues, it will be a less fiery battle and the children won't be put in the position of hearing their parents fight with each other over the phone or in person. Deal with the problems like adults by going through the attorney to get tough issues resolved.


File for Custody

If you haven't already done it, it is time to file for custody of the children if you think it is appropriate for your situation. The only way to resolve the issues are to have them put into the custody agreement. Visitation with the other parent will be a major issue. Make sure that you are fair about the visitation. If not, the other parent will certainly fight for the right to see their children more often and the battle could go on for years. The judge will have the final say in the matter and his word will have to be heeded.



File for a Change

If there is a custody order already in place and there are issues that arise, you can always file for a change in the custody order. This shouldn't be used for petty reasons. It should only be used if there is an unreasonable action by the other parent that could cause harm for your child. If you start to go to court for every petty thing, the judge isn't likely to look kindly upon it.

The main issue in a custody suit is that the children are the first priority. Your feelings have very little to do with it. Your children need the involvement of both parents in their lives where possible. Don't take your anger at your ex out on your children. Be fair to them and you will notice a big difference in how things turn out.
