A Debt Relief Attorney Can Stall Your Creditors

By: Nick Messe | Posted: 27th May 2010

How can a debt relief attorney stall your creditors and stop the harassment? That's the question that many people have on their minds these days. People who in good faith incurred debts during better times have run smack up against the grim economics of today. Bankruptcy is a remedy for people who are living the nightmare of crushing debt and a good Bankruptcy Lawyer will show you the way back to financial sanity.

If you are researching this subject, you have probably been contacted by a creditor or two. To put it another way, you are probably being harassed by several. This harassment is another of today's facts of life. You have probably attempted to explain your situation to them, to reasonably deal with them, and you have found out that it can't be done.

To put it bluntly, creditors don't care. They may threaten you, they may do their best to scare or intimidate you, they may even outright lie to you. You don't have to be scared. In fact, you don't have to deal with creditor's harassment at all.

You need to do one simple thing, and that is to find a good bankruptcy attorney. He can answer any and all bankruptcy questions you have, the ones that have been keeping you awake nights. When you become his client, he will immediately do one very important thing for you. He will stop your creditors and their harassing calls in their tracks.

When the creditors call, you simply tell them your lawyer's name and give them his phone number. They then have to direct any and all correspondence to your lawyer. When you go to bankruptcy court, your lawyer goes with you. He speaks for you.

If you have no secured debts, that is, debts that weren't secured by collateral, and if you don't own a home, you are basically done. Your debts will be discharged, which means you don't owe them anymore. Perhaps your case is a bit more complicated, if you own a home and have secured debts such as a large car loan or the like, your lawyer will work on a settlement, such as a restructuring of your debts and payments. This is sometimes called a Chapter 13 bankruptcy.

Your debts aren't discharged, in this case, but they aren't crippling you as they were before. You will be able to make a new start and get your life back. It will take time and sacrifice. You may have to trade your car for something less shiny and more practical.

You will have to cut up your credit cards and use debit cards or cash. You will have to live on a no-nonsense budget and as with any kind of diet, you will accustom yourself to deal with what you need, not what you want. By keeping disciplined and following your bankruptcy lawyer's advice, you can rehabilitate your credit, but it takes patience. After all, you didn't get into this situation overnight.
