A parent's worst fear is that something horrific will happen to their children. Child abuse happens every day and often by the people closest to the children. When child abuse has taken place by a parent, caregiver, teacher or stranger legal action will be taken. Often child abuse leads to criminal charges, but the child may be entitled to file a civil lawsuit as well.

WHO CAN A CHILD ABUSE LAWSUIT INCLUDE?

In some states child abuse victims can be entitled to compensation from the abuser as well as from people that should have reported the abuse and failed to do so such as a doctor or teacher. Those states feel that the lack of reporting leads the child to suffer from more child abuse that could have been avoided if properly reported.

TYPES OF CHILD ABUSE LAWSUITS

Child abuse lawsuits are often brought by the parents of the abused or neglected child. Oftentimes, the child abuse lawsuit is against a daycare, foster home, teacher, or coach. A child abuse lawsuit not only encompasses physical harm to a child but can also include emotional harm. Some other types of neglect or abuse that are also included in child abuse lawsuits are failing to provide medical treatment, failing to provide supervision, and the child is subsequently harmed and failing to recognize a serious medical condition which results in injury or death to the child.

WHAT TO DO IF CHILD ABUSE HAS OCCURRED

It is very important that if a child is being neglected or abused that the proper authorities be notified. After reporting the child abuse to the proper authorities you may want to seek legal counsel. As with any civil lawsuit, child abuse lawsuits are often subject to limitation on filing a lawsuit against the abuse so it is important to seek the advice of an experienced child abuse attorney to determine whether or not the case if viable.
